“Unbelievable,” is how Kawartha Lakes councillor Heather Stauble described recent actions buy the Ontario Environmental Review Tribunal, related to the appeal of the 10-MW Settlers’ Landing wind power project.

The councillor had inquired about Notice, saying that many people interested in the project and who had taken the time to comment on it, had not received word about the preliminary hearings.

The response from the ERT was as follows.

Thank-you for your inquiry regarding the Notice of the Preliminary Hearing and Hearing in the SLWP appeal against Settler’s Landing Wind Park. While Rule 31(b) of the Environmental Review Tribunal’s Rules of Practice and Practice Directions require that the Director, Ministry of the Environment and Climate Change provide the Tribunal with a list of those “who made submissions to the Director regarding the renewable energy project or who have given notice to the Director that they have an interest in the renewable energy project”, the MOECC has raised concerns that the provision of such information is not in accordance with the Freedom of Information and Protection of Privacy Act.    Having taken such concerns into consideration, the Tribunal has exercised its authority under Rule 5 and waived the requirement that the Director provide this information.  Further, changes to the Tribunal’s Rules of Practice are in process and will remove this provision.
